What people in Tambaram usually need
Tambaram is a large and fast-growing suburb, with many families who moved here for more space and commute into the city by suburban train or along GST Road. The questions we hear from the area tend to be practical.
- “We both agree to separate. What is the quickest proper way?”
- “My spouse refuses to agree. Can I still get a divorce?”
- “How do we settle the children’s school, custody and visits?”
- “My spouse has stopped paying for the household. Can I claim maintenance?”
- “My spouse lives abroad or in another city. Do I have to keep travelling?”
The sections below answer each of these and show you how to book the right advocate.
Which court will hear a case from Tambaram

This is the first thing to settle. Tambaram falls in Chengalpattu district, not Chennai district. So a divorce based only on a Tambaram address may belong before a court for Chengalpattu district rather than the Family Court in Chennai.
That is not the whole story. Under Section 19 of the Hindu Marriage Act, 1955, a petition can be filed where the marriage took place, where the respondent lives, where the couple last lived together or, if the wife is filing, where she lives on the date of filing. If you married in Chennai, or your spouse now lives in the city, a Chennai court may also be an option.
Ask your advocate to compare the valid options with you. The right choice can save a lot of travel over months of hearings.
Mutual consent or contested divorce

If you both agree, a mutual consent divorce under Section 13B of the Hindu Marriage Act is usually the faster and cheaper route. You must have lived separately for at least a year. After the first motion there is normally a six-month gap before the second motion, which the Supreme Court in Amardeep Singh v. Harveen Kaur (2017) held can be waived in suitable cases. Our mutual divorce process guide walks through each step.
A mutual consent case is only quick when every term is settled before filing: custody, visits, maintenance or a one-time settlement, and who keeps any flat or vehicle.
If your spouse will not agree, you file a contested petition under Section 13 on a ground such as cruelty or desertion for at least two years. These cases depend on evidence and often take years. Christian couples file under the Indian Divorce Act, 1869, and couples married under the Special Marriage Act, 1954 under that Act; the grounds and waiting periods differ, so tell your advocate which law your marriage falls under.
Maintenance, children and the home
Money and children are often harder to settle than the divorce itself.
- Interim maintenance: while the case is pending, either spouse with insufficient income can ask for maintenance and litigation costs under Section 24 of the Hindu Marriage Act.
- Permanent alimony: the court can order it under Section 25 at the time of the decree or later.
- Maintenance in the Magistrate’s court: a wife, children and parents can claim under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 125 CrPC).
- Custody: the child’s welfare is the main consideration. Interim custody and visitation can be ordered while the case runs.
- Safety: if there is abuse, the Protection of Women from Domestic Violence Act, 2005 allows protection, residence and monetary orders.
In maintenance cases, both sides must now file an affidavit of assets and income, following the Supreme Court’s decision in Rajnesh v. Neha (2020).
What to prepare before the first call
- Marriage certificate or invitation and photographs.
- ID and address proof for you, and your spouse’s current address.
- Children’s birth certificates and school details.
- Salary slips, income tax returns and bank statements.
- Documents for any shared property, home loan or vehicle.
- A short, dated timeline of what happened and when you separated.
- Any police complaint, legal notice or earlier court order.
Bring copies, not originals, to the first meeting.

Phone and video consultations

You do not have to travel into the city for every conversation. First consultations, document reviews and many updates can happen by phone or video, which suits people who commute long hours or whose spouse lives in another city or abroad.
Court appearances are a different matter, and the rules depend on the court and the stage of the case. Ask your advocate which hearings need you in person.
How to choose, and what it costs
Shortlist two or three advocates and put the same questions to each.
- Do you regularly handle my type of case?
- Which court do you think my case belongs in, and why?
- Will you appear at hearings yourself?
- What is your fee, in writing, and what does each stage cover?
As a broad guide, total lawyer fees for a mutual consent divorce in Chennai typically fall between ₹15,000 and ₹75,000; contested cases usually cost more. See our page on divorce lawyer fees in Chennai for what drives the cost. Walk away from anyone who guarantees a result; no honest advocate can.
Frequently asked questions
Can a divorce case from Tambaram be filed in Chennai?
Sometimes. It depends on where you married, where your spouse lives, where you last lived together and, if the wife is filing, where she lives. Tambaram itself is in Chengalpattu district, so check jurisdiction with your advocate first.
How long does a mutual consent divorce take?
Usually several months, because of the six-month gap between the two motions, which the court can waive in suitable cases. Contested divorces often take years.
Can I claim maintenance while the divorce is pending?
Yes. Under Section 24 of the Hindu Marriage Act, a spouse without sufficient income can ask for interim maintenance and litigation costs while the case runs.
Do I need to meet the lawyer in person?
Not at first. The first consultation can be by phone or video. You will usually need to sign papers and attend some hearings in person.
