The documents required for divorce in India are mainly proof of your marriage, proof of identity and address for both spouses, proof of separation or of the ground you rely on, and financial and child-related papers if maintenance or custody is involved. The exact list depends on whether the divorce is by mutual consent or contested, and on the law under which you married. This checklist explains what to collect and why each document matters.
Gathering these papers early saves time. Missing documents can lead to adjournments and avoidable delay.

Basic documents required for divorce in India
Almost every divorce petition, mutual or contested, needs the following:
- Proof of marriage: the marriage registration certificate, if the marriage was registered. If not, a wedding invitation, wedding photographs, and if available a certificate from the temple, church, mosque or hall where it took place.
- Identity proof: Aadhaar, passport, voter ID or driving licence of both spouses.
- Address proof: current address of both spouses. This also helps show the court has jurisdiction.
- Passport-size photographs: of the petitioner, and of both spouses in a mutual case.
- Vakalatnama: the document authorising your advocate to appear for you. Your lawyer prepares it for signature.
- Details of children: names, dates of birth and birth certificates, if you have children.
Keep the originals safe and give your lawyer clear copies. Originals are usually needed only for verification or when evidence is recorded.

Proof of marriage under different laws
| Law | Usual proof of marriage |
|---|---|
| Hindu Marriage Act, 1955 | Marriage registration certificate, or invitation, photos and evidence of the ceremony |
| Special Marriage Act, 1954 | Marriage certificate issued by the Marriage Officer |
| Indian Christian Marriage / Indian Divorce Act | Church marriage certificate or register extract, or registration certificate |
| Muslim law | Nikahnama, with any registration certificate if available |
An unregistered marriage is still valid if it was properly performed. Lack of a registration certificate does not stop you from filing; it only means you prove the marriage by other evidence.
Extra documents for mutual consent divorce
In a mutual consent divorce under Section 13B of the HMA (or Section 28 of the SMA, or Section 10A of the Indian Divorce Act), both spouses file together. In addition to the basic papers, you will need:
- Proof of separate living: documents showing you have lived apart for at least one year (two years under the Indian Divorce Act), such as separate rental agreements, utility bills or employment records at different addresses.
- Settlement terms in writing: the agreed alimony or one-time payment, return of jewellery and stridhan, custody and visitation, and division of any property.
- Affidavits from both spouses: supporting the joint petition and confirming free consent.
- Payment details: how and when any settlement amount will be paid, for example by demand draft at the second motion.
If one spouse lives abroad, add a copy of the passport and visa, and, if the court allows representation, a properly executed power of attorney. Our guide to the mutual divorce process online explains how overseas spouses take part.
Extra documents for a contested divorce
In a contested case, the court decides on evidence. Collect documents that support the ground you rely on under Section 13 of the HMA or the corresponding law:
- Cruelty: medical records, photographs of injuries, police complaints, messages or emails showing abuse, and names of witnesses.
- Desertion: proof of the date your spouse left, communication showing refusal to return, and evidence that you did not cause the separation. The period must be at least two years before filing.
- Adultery: any material showing the relationship, such as messages, photos or hotel records.
- Unsound mind or other grounds: medical records and expert opinions where relevant.
- Any earlier legal notice and its reply, and any prior cases between you.
Electronic evidence such as WhatsApp messages and emails is usually filed with a certificate about how it was produced. Your lawyer will advise on the correct format.

Financial documents for maintenance and alimony
If maintenance, interim maintenance under Section 24 of the HMA, or permanent alimony under Section 25 is involved, the court will look closely at both spouses’ finances. In Rajnesh v. Neha (2020), the Supreme Court directed that both parties file an affidavit disclosing their assets and liabilities in maintenance proceedings.
Prepare:
- Recent salary slips and Form 16
- Income tax returns for recent years
- Bank statements
- Details of property, investments, loans and EMIs
- Monthly household and child expenses, with bills where possible
Being complete and honest here helps. Hiding income usually comes out and damages credibility.
If your spouse is self-employed or runs a business, note what you know about the business, its premises, vehicles and lifestyle spending. The court can draw conclusions from this when declared income looks too low.
Documents for child custody
If custody is part of the divorce, the court considers the child’s welfare first. Helpful papers include:
- Birth certificates of the children
- School admission, fee receipts and report cards
- Medical and vaccination records
- Proof of your role as caregiver and your work schedule
- Any evidence relevant to the child’s safety
Read our overview of child custody laws in India to understand how courts weigh these documents.
Documents for stridhan, jewellery and property claims
If you want your jewellery, gifts or other stridhan returned, or if the couple owns property together, collect proof early. Useful papers include:
- Wedding photographs showing jewellery, and purchase bills where available
- A list of items given at the wedding, with who gave them
- Bank locker details and any locker access records
- Sale deeds, loan documents and EMI records for jointly bought property
- Vehicle registration and insurance papers
A written inventory is much easier to settle on, whether in a mutual settlement or in a contested claim.
Documents you receive after the divorce
Once the court grants the divorce, apply for a certified copy of the decree and the judgment. Keep several copies.
You may need the decree to remarry, to update your name or marital status in your passport and other records, to change nominations in bank accounts and insurance, and to show the terms of custody or maintenance if there is a later dispute.
Quick checklist before your first meeting
- Marriage certificate or other proof of marriage
- ID and address proof of both spouses
- Photographs
- Children’s birth certificates, if any
- Proof of separation or evidence for your ground
- Income, tax and bank records
- Draft settlement terms, if mutual
- A short written timeline of the marriage and key events
The written timeline is not a court document, but it helps your lawyer draft an accurate petition quickly. Once your papers are ready, see our step-by-step guide on how to file for divorce in Chennai, and the full mutual divorce process if you and your spouse agree.
Frequently asked questions
Can I file for divorce without a marriage certificate?
Yes. If your marriage was not registered, you can prove it with invitations, photographs, ceremony records and witnesses.
Do I need my spouse’s documents for a contested divorce?
You need your spouse’s correct name and address so notice can be served. You do not need their signature or their personal documents to file.
Are WhatsApp chats accepted as evidence?
They can be, if filed in the proper form with the required certificate for electronic records. Keep the original phone and backups safe.
Do documents need to be notarised?
Affidavits are sworn before an authorised officer or notary. Most supporting documents are filed as copies. Your lawyer will tell you what needs attestation.
